FCC proposes $2.8 million fine against HobbyKing
« on: June 07, 2018, 12:56:01 AM »

Wonder if any other countries will follow suit?

FCC proposes $2.8 million fine against HobbyKing
« Reply #1 on: June 07, 2018, 09:44:55 AM »

I am not at all surprised by that move. I had a similar e mail from AAK TEC stating that they where ceasing production of certain vtx due to pressure from the FCC. I think that the U.K. has a more lenient attitude in that itís the use not the purchase of a product that is illegal. Unless itís fags to children, Fixed blade knives, firearms, aerosols, glue, alcohol, gunpowder. We are more interested in recovering VAT and other duties I.e. the prosecution of Giant Cod a few years back.

Sounds like it could be a good time to start stocking up on VTx's! I know Hobbyking is probably the biggest player worldwide, but would $2.8 million end them?

No where near, they are huge.
Anthony Hand is now the sole owner and also owns Durafly, OrangeRX and Turnigy (probably others too). To my knowledge Hobbyking have 7 warehouses worldwide and probably carry substantially more than $2.8 million in each of them. Then there are his other brands.......

It may have put a dent in their bog roll budget but I don't think they are going anywhere soon ;)

I think that is indeed the case. Manufacture and possession is legal but use is not. An easy example is a TV. You only need a licence to use it as a broadcast band receiver. So you could in theory remove the receiver part and use it solely as a monitor. At that point it still looks like a TV but cannot function as one.
Looking at it another way, the little guy (user) is an easier target. The big guy (manufacturer) has more resources to mount a legal defence or avoid a case being brought. I'm thinking here of tax avoidance and a few huge corporations.

Why pick on Hobbyking..?....What about all the other suppliers in China providing goods directly to the UK...?

Im sure they could use that as an argument, and it would be a valid one too.

Pretty sure it'll be because HobbyKing are in business in the US and don't only ship direct from China.

Not sure about now but UK on transmission used to be that it's legal to sell and own any radio transmitter but you can only broadcast as long as you follow rules.
So selling transmitters (VTX or TX) that are capable of breaking UK laws is probably completely legal in UK.

It's the FCC going after HobbyKing, the FCC being in the USA. If UK it would be OfCom.

Has anybody on the planet noticed that half of the 'Raceband' channels are outside the ISM spec, and are illegal to use, even at 25mW?
Or have I got it wrong?

They wouldn't sell what we don't use...... or is it the other way around?

No, you've got it right.  I was sent the Blade version of the ImmersionRC Vortex Mojo 230 where they'd locked it down to conform with EU regs.  You can only have 25mw and half of raceband is greyed out along with a few other channels on other bands as well

Yep cheers CK, I thought so.
That's why Fatshark 8 is sometimes missing - cos it's 5880 and the band stops at 5875.
Strange goings on, considering 'legal' races are monitored for strict compliance with 25mW.

At 25mw who is going to complain or be affected by it unless you were right next to someone.
